Terms of service

These Terms of Service ("Terms") govern your access to and use of the website and services provided by Event Biologic Inc. ("EVENT," "we," "us," or "our"), including the EVENT biological specimen collection and custody service (the "Service"). By purchasing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not purchase or use the Service.

1. What EVENT Is

EVENT consists of two separately purchased components: (a) the EVENT Collection Kit, a one-time, $49.99 purchase providing an at-home saliva collection kit, and (b) Professional Specimen Custody, a service providing long-term, professionally managed preservation of a collected specimen through a biorepository partner, billed at $120 per 12-month term, per preserved collection. Purchasing a kit does not begin Professional Specimen Custody or any recurring charge, and a kit may remain unused indefinitely at no additional cost. Custody begins only when you activate and return a collection.

The same kit supports two uses, selected by you at the time of activation: Reference (collected while you are healthy, to preserve an earlier biological point in time) and Event (collected following a meaningful health event, such as a concussion or head impact, stroke or suspected neurological event, accident or trauma, acute illness, new symptoms, diagnosis, or major medical procedure or treatment). These are examples of collection triggers, not diagnostic claims. EVENT does not test, analyze, diagnose, or interpret your specimen at the time of collection or custody. Any future analysis is a separate matter, to be requested and consented to by you, or where applicable your future authorized representative, at a later time.

2. Not Medical Advice, Diagnosis, or Treatment

Event Biologic Inc. is not a medical provider. EVENT is not initially a diagnostic laboratory, testing service, biomarker dashboard, interpretation service, health-record platform, wearable integration company, medical decision-support platform, insurance product, or forensic evidence company. EVENT does not diagnose, predict, monitor, or determine recovery from concussion, stroke, or any other condition, and does not determine an individual's readiness to return to play, work, or activity. Nothing provided as part of the Service should be relied upon as medical advice. All medical decisions remain the sole responsibility of your qualified healthcare provider.

3. Eligibility and Minors

If you are under the age of majority in your jurisdiction, a parent or legal guardian must make the purchase, provide consent, and agree to these Terms on your behalf. Upon reaching the age of majority, we will seek your own re-confirmation of consent before continuing to hold, or before honoring any previously granted research-participation consent given on your behalf regarding, your specimen.

4. Purchase and Billing

The EVENT Collection Kit is a one-time purchase and does not obligate you to purchase Professional Specimen Custody. You may purchase one or more kits, and each may remain unused indefinitely at no additional cost. Professional Specimen Custody is billed separately, per preserved collection, at $120 for each 12-month custody term, beginning only when that collection is activated and accessioned. If you maintain custody of more than one preserved collection (for example, a Reference and a later Event), each is billed and tracked independently, and your total custody cost scales with the number of collections you maintain in custody, not a flat per-customer fee. At this time, custody renewal is not automatically billed; before a given collection's current term ends, we will make reasonable efforts to contact you with the option to renew that collection's custody for an additional 12-month term. If a collection's custody is not renewed, see Section 9 (Non-Renewal and Lapse) below.

5. Kit Fulfillment

Kits are fulfilled in the order purchases are received, subject to manufacturing and collection-material availability. We will communicate expected shipment timing to you and will notify you if timing changes materially. Fulfillment timing is not guaranteed to a specific date unless separately confirmed in writing.

6. Your Responsibilities During Collection

The usability of your specimen depends on following the collection and return-shipping instructions provided with your kit exactly, including timing instructions, and, for an Event collection, accurately recording the event and collection timing information requested during activation. EVENT is not responsible for degraded, compromised, or unusable specimens resulting from a failure to follow provided instructions, delayed return shipment by you, or circumstances outside our control, such as carrier delays.

7. The Specimen Journey

Once your kit is returned, your specimen generally moves through the following stages: collection by you, return shipment to us, verification and inspection upon receipt, accession and registration into our biorepository partner's inventory system, preservation under validated storage conditions, and ongoing tracking through a validated inventory system for the duration of that collection's custody term. We will make reasonable efforts to notify you of meaningful stages in this process. Any damage, discrepancy, or concern identified upon receipt of your kit will be documented and communicated to you.

8. Consent Categories

You may designate a specimen as Private (held solely for your own future access, with no research use or sharing absent your separate, specific future consent) or you may separately opt into one or more Contribute categories: Internal Research (coded/de-identified use in EVENT's own research), Partner Research (coded/de-identified data may be licensed to vetted third-party research or commercial partners for their own product development, under contractual restrictions including a prohibition on re-identification), and Players' Association Advocacy Reporting (aggregate, de-identified statistics may be shared with your players' association, where applicable, for collective advocacy purposes; no individual-level data is ever shared under this category). Selecting any Contribute category does not affect your price and may be changed, in either direction, at any time, at no cost, by contacting us using the information in Section 15. We may also, from time to time, contact you separately to request specific, additional consent for a new individual analysis method that becomes available; this Section does not itself grant consent to any such future method.

9. Non-Renewal and Lapse

If a preserved collection's Professional Specimen Custody is not renewed before its current term ends, we will make reasonable efforts to contact you with notice before taking further action. Continued non-response or non-renewal may eventually result in destruction of that specimen following additional notice; exact grace-period timing will be specified in your custody confirmation. You may also affirmatively request destruction, transfer, or continued custody of any preserved collection at any time, whether or not its term is ending.

10. Retrieval

A preserved specimen is held so that, subject to your authorization, it can potentially be retrieved for appropriate future analysis. Retrieval requests are verified against your identity and authorization before any release. We do not promise that any particular future analysis will be possible, available, or clinically useful; the science and technology available at any future point in time cannot be guaranteed today.

11. Destruction

You may request destruction of a specimen at any time by contacting us. Destruction requests are independently verified before being carried out and are performed by a qualified vendor. Upon request, we will provide confirmation that destruction has occurred. Requesting destruction does not entitle you to a refund of amounts already paid; see our Refund Policy.

12. Intellectual Property

All content on this website, and the "EVENT" name and mark, are the property of Event Biologic Inc. or its licensors. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

13. No Warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any specimen will remain analyzable indefinitely, or that any specific future clinical, research, or legal use of a specimen will be possible.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Event Biologic Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues, arising out of or related to your use of the Service.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles; any dispute will be brought exclusively in the state or federal courts located in Delaware.
